Just curious – did you pay for the right to use the Ellison and Silver clips?
They were uploaded with permission of the creators to Youtube and embed enabled. Which means they are shared willingly by the copyright holder. Just as if you use the clip of me on your blog, you don’t have to pay me. You see, the copyright holder has the right to make that decision. No one else does.
The Ellison clip was used to advertise a documentary about Ellison, the Silver clip was uploaded and shared by the artist himself, and I willingly lent myself to the Copyright Alliance.
The obvious difference here is the non-commerical educational or promotional use we willingly provide you, as opposed to the commercial entertainment use a company like Warner Brothers might make of the same material without compensation against our will.

EDIT: FYI, usually the person being interviewed doesn’t own the copyright, the person making the film does. You sign a release stating that fact when you do an interview.

I have the Harlan Ellison documentary, it’s very interesting. The bonus feature of him and Neil Gaiman dining was really good. I admit, that I’m not as well-versed in his oeuvre as I should be but he certainly is a compelling character and got where he was coming from at certain points in the documentary (e.g. talking about being motivated to move away from where he was from and then coming back and seeing how the popular kids all became washed-up). Definitely will be scouring B&N or Amazon.com for collections of his works. Any recommendations?
I had shown that clip of “Pay the Writer” to a friend of mine who does some tech consulting on the side and he loved it. Told me a story that resembled Harlan’s a bit. He was doing a job for some day trader and after the trader agreed to the system upgrades and repairs he balked at the price and tried to low-ball my friend. My friend said how he asked the guy how much, on average, he makes in a day. The trader told him, as if to gloat, but then fell for the trap. My friend replied how if the trader broke it down, he was only charging the equivalent of what the trader would make in less than an hour. Then pointed out how much the trader will lose every day after due to not having his system fixed and asked if that was worth it to not pay the tech the money? Joked how the shocked expression on the trader’s face was payment enough but still liked those new zeroes in his bank balance.
There are so many people who can’t see past the “I got it for FREE” part of online theft. Drives me nuts when someone brings a hard drive into the office full of downloaded movies and tv shows and music. I’m fortunate to have many friends in various arts communities (actors, artists, musicians), and knowing them makes it very personal when someone doesn’t understand that it is theft, pure and simple. You and Harlan and Neil and everyone who makes art for a living (or hobby) has my full support, and money (when I have it!).
